I'd Sue Too

Couple sues over "overzealous" protection of newborn: OK, I have family who work in protective services, and I so know how stressed and overextended these agencies are. But knowing that only makes me wonder how anyone could justify the resources spent on this case, in which a mother who had a homebirth called a hospital for help when her newborn's appetite seemed low. Instead of help, she got a visit from police escorted by an ambulance; they'd been told the couple hadn't been feeding ANY of their eight children! They were more or less forced to take the baby to the hospital, where he was pronounced happy and healthy, and the social workers STILL tried to take the baby away! There are so many kids in real danger who time and again don't get the help they need, and still the social service agencies seem to prefer to focus on innocent families with nothing wrong--in this case just because a hospital nurse doesn't approve of homebirths. Amazing.

I really don't understand this...

Why is it that social workers are routinely allowed to violate the constitutional rights of parents by demanding entry into the home without a warrant? Obviously, any social worker presenting this to a judge would have been shot down. The mother was so right when she asked where on earth these people's common sense has gone. Why would she call a consultant if she were a neglectful parent? DUH!

Well, to be precise, according to the article it was the police who were at the scene and later tried to take the newborn to the home - could that have been the problem here (in part), that officers untraiend/inadequately trained made a bad call?
'Course, I'd sue too. In a heart beat.
Susanna - social workers are allowed into homes I *believe* on the basis that they can ALWAYS bust in if they think someone's in danger, much like if they hear a woma nscream from inside the house, the polce can bust down the door without a warrant. It seems like a gross over extension of the concept, though.

especially when they are acting on anonymous tips. Which is the case surprisingly often.
